These Terms of Service (“Terms”) are an agreement between you and Warby Prep LLC (“textgf,” “we,” “us”), which operates the textgf service at textgf.com. By signing up for or using textgf, you agree to these Terms, our Privacy Policy, our SMS Terms, our Subscription & Cancellation Terms and our Safety & Community Guidelines.
1. What textgf is
textgf is a subscription service that lets you exchange text messages with a real person (“texter”) based in the United States for friendly conversation. textgf is for companionship and conversation only.
textgf is not: a dating, romance or adult service; therapy, counseling, coaching or any medical, mental health, legal or financial service; or a crisis or emergency service. Texters are not licensed professionals and do not give professional advice. If you are in crisis, call or text 988 (Suicide & Crisis Lifeline). In an emergency, call 911.
2. Eligibility
You must be at least 18 years old, able to form a binding contract, and have a U.S. mobile number that you own or are authorized to use. By signing up you confirm that you meet these requirements. We may ask you to verify your age or identity and may close accounts that don’t meet them.
3. Your account and number
You are responsible for the mobile number and email you give us and for activity on your subscription. Tell us right away at info@textgf.com if your number changes or you believe someone else is using your subscription.
4. Plans, replies and billing
Plans include a set number of replies from your texter each month, as described on our Pricing page. A reply is one text message sent by your texter, regardless of how your carrier splits it. Unused replies do not roll over. Response times are targets, not guarantees, and depend on your plan and our service hours. Trials, renewals, cancellations and refunds are covered by our Subscription & Cancellation Terms. Payments are processed by our payment processor, Stripe; we do not store your full card number.
5. Rules of conduct
To keep textgf friendly and safe for everyone, you agree not to:
- send sexual, sexually suggestive or romantic content, or request it;
- ask to meet your texter in person, or ask for or share phone numbers, addresses, social media accounts or other contact details off the service;
- offer, request or send money, gifts or anything of value to or from a texter;
- harass, threaten, abuse, demean or discriminate against a texter or anyone else;
- send illegal content, or content that promotes violence, self-harm or illegal activity;
- impersonate anyone, share another person’s private information, or use the service for any unlawful purpose;
- use automated systems, spam, or attempt to resell or share the service.
We may warn, pause or end your subscription, without refund, if you break these rules. We may report threats of harm to others to appropriate authorities.
6. Texters
Texters are real people who work with textgf. They use first names only, follow our guidelines, and may be supported by a backup texter so you are not left without a reply. We match you with a texter based on the style you choose; we can’t guarantee a specific texter will always be available. You can ask to be rematched at any time.
7. Safety and wellbeing
Texters are trained to notice when someone may be in danger and to share crisis resources such as 988 and 911. If a message suggests a risk of serious harm to you or someone else, we may pause the conversation, share crisis resources, and, where we believe in good faith that there is an imminent risk, contact emergency services. Our response is limited; textgf is never a substitute for emergency help.
8. Privacy and monitoring
Conversations are stored and may be reviewed by authorized textgf staff for quality, safety, training and to enforce these Terms. See our Privacy Policy for details.
9. Content
You keep ownership of what you send. You give us a limited license to store, transmit and review your messages to provide and improve the service and keep it safe. Our site, name, logo and materials belong to Warby Prep LLC.
10. Disclaimers
textgf is provided “as is” and “as available.” Conversations reflect the personal views of texters, not professional advice. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and we don’t guarantee the service will be uninterrupted, error-free or available on every carrier.
11. Limitation of liability
To the fullest extent permitted by law, Warby Prep LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to textgf is limited to the amount you paid us in the three months before the claim arose.
12. Indemnity
You agree to indemnify and hold harmless Warby Prep LLC and its texters and staff from claims arising from your misuse of the service or violation of these Terms.
13. Ending the service
You can cancel anytime as described in our Subscription & Cancellation Terms. We may suspend or end the service, or your access, at any time, including for breaking these Terms. If we discontinue textgf entirely, we will refund any prepaid, unused period.
14. Governing law and disputes
These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at info@textgf.com so we can try to resolve it informally. Any claim that is not resolved will be brought in the state or federal courts located in Connecticut, and you and we consent to their jurisdiction. Either party may bring an individual claim in small-claims court.
15. Changes
We may update these Terms. If we make material changes, we’ll notify you by text or email before they take effect. Continuing to use textgf after that means you accept the updated Terms.
